The United States Department of Justice recognized a "qui tam" whistleblower action against the nationwide pharmacy CVS Caremark Corp. as one of the top ten national recoveries under the False Claims Act. CVS Caremark, one of the nation's largest pharmacy chains, was charged with switching generic drugs to garner huge profits by evading federal and state Medicaid price limits. This case was pursued for over five years by Illinois pharmacist whistleblower Bernard Lisitza and his Chicago attorneys Michael I. Behn and Linda Wyetzner of Behn & Wyetzner, Chartered, under federal and state False Claims Acts. Behn and Wyetzner represent qui tam "relators," such as pharmacists, doctors, nurses and auditors, in cases involving Medicaid and Medicare fraud, pharmacy and pharmaceutical fraud, defense contracting and procurement fraud, and other False Claims Act prosecutions. Behn & Wyetzner is an affiliate of the Whistleblower Action Network, a team of attorneys dedicated to representing relators under the False Claims Act. A $400 million Medicaid fraud settlement with Merck & Co., Inc., handled by another Chicago Whistleblower Action Network attorney, Steven H. Cohen, was also highlighted as one of the nation's top ten False Claims Act settlements. (PRWeb Dec 2, 2008)
